1. Acceptance of Terms
By visiting our website, requesting a quote, purchasing services from ClearPath Landscaping (“ClearPath,” “we,” “us,” or “our”), or opting in to receive text messages from us, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use our services.
2. Description of Services
ClearPath provides residential and commercial landscaping services, including lawn mowing and maintenance, mulch installation, planting, yard cleanups, landscape design and installation, sod installation, hedge trimming, and general property upkeep. Specific scope, schedule, and pricing for any engagement will be confirmed in a quote or service agreement.
3. Quotes and Pricing
Quotes are provided in good faith based on the property details and scope shared at the time of the quote. We may revise a quote if the scope changes or if on-site conditions differ materially from what was described. Quotes are valid for 30 days unless otherwise noted. Quotes are free and create no obligation.
4. Scheduling, Access, and Weather
We will agree to a service schedule with you in advance. You are responsible for providing reasonable access to the property (gates unlocked, pets secured, vehicles cleared). We may reschedule service when weather or site conditions make safe or quality work impossible. Rescheduled visits are completed at the next available opportunity.
5. Payment Terms
Payment terms are set out in your quote, service plan, or invoice. Unless otherwise stated, invoices are due within 14 days of issue. Late payments may incur reasonable late fees and may result in suspension of recurring services until the balance is cleared.
6. Cancellation
You may cancel a one-time service at least 24 hours before the scheduled appointment without charge. Cancellations made within 24 hours of the scheduled time may incur a partial fee. Recurring maintenance plans can be cancelled at any time with reasonable notice; services already performed will be billed normally.
7. Customer Responsibilities
You agree to disclose known hazards (irrigation lines, low fences, invisible pet fences, septic covers, etc.) and to keep the property clear of obstacles and pet waste before service visits. We are not responsible for damage to undisclosed or unmarked items.
8. Photos and Marketing
We may take before-and-after photos of completed work for our own portfolio, website, and marketing use. Photos will not include personally identifying details (license plates, house numbers, visible mail) without your consent. Let us know in writing if you prefer your property not be photographed.
9. Limitation of Liability
To the maximum extent permitted by law, ClearPath’s total liability arising out of or relating to these Terms or our services is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. ClearPath is not liable for indirect, incidental, special, or consequential damages.
10. SMS / Text Messaging Program
By providing your mobile phone number and opting in to receive text messages from ClearPath, you consent to receive recurring messages from us related to our services. The terms of our SMS program are:

Message frequency varies based on your service plan and your interactions with us. You may receive recurring messages tied to your active service schedule and any inquiries you initiate.

Message and data rates may apply. Your mobile carrier may charge for messages sent to and from you. Check your wireless plan for details.
Help and opt-out
To stop receiving text messages from ClearPath Landscaping at any time, reply STOP to any message we send. You will receive one final confirmation message and then no further messages from the program.

Carriers are not liable for any delayed or undelivered messages.

Our SMS program is supported on all major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, Cricket, MetroPCS, and Virgin Mobile, subject to carrier availability.

11. Governing Law
These Terms are governed by the laws of the state in which ClearPath operates, without regard to its conflict-of-law principles. Any dispute arising from these Terms or our services will be resolved in the courts located in that state, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
